1. Acceptance of Terms

By accessing or using PicFlow ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PicFlow provides AI-powered product photo processing including background removal, scene generation, and platform-specific image resizing. The Service is provided on a subscription basis with pricing tiers as described on our website.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete registration information.
  • You must be at least 16 years old to use the Service.
  • One account per individual or business entity unless otherwise agreed.

4. Payment Terms

Payments are processed by Lemon Squeezy, our Merchant of Record. By subscribing, you agree to Lemon Squeezy's terms and the pricing displayed at the time of purchase.

  • Subscription fees are billed in advance on a monthly basis.
  • Overage charges apply when you exceed your plan's image limit, at the rate specified in your plan.
  • All fees are in USD and are non-refundable except as required by law.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that infringes on intellectual property rights of others
  • Upload content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Attempt to bypass usage limits or abuse the Service in a way that degrades performance for other users
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools (bots, scrapers) to access the Service without permission

6. Intellectual Property

  • Your content - You retain all rights to the images you upload and the images generated by the Service. PicFlow does not claim ownership of your product images.
  • Our service - PicFlow, its branding, code, and infrastructure are our intellectual property. You may not copy, modify, or redistribute the Service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. PicFlow uses dual AI model redundancy to minimize downtime, but occasional interruptions may occur due to maintenance, third-party service outages, or events beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, PicFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

The Service is provided "as is" without warranties of any kind, either express or implied.

9. Termination

We reserve the right to suspend or terminate your account for violation of these terms. You may terminate your account at any time by canceling your subscription. Upon termination, your right to use the Service ceases immediately.

10. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws applicable to the jurisdiction where the Service operator is based. Any disputes shall be resolved through binding arbitration where permitted by law.
